Arbopals Inc. (“Arbopals”) is committed to providing fun, educational and safe activities for people of all ages using the Arbopals Website and Virtual World (the “Site”).
The Arbopals Privacy and Security Policy describes: (i) the type of information Arbopals collects from users of the Site, including information that identifies a particular individual, such as the individual’s full name, mailing address, and/or email address (“Personally Identifiable Information” or “PII”); (ii) why Arbopals collects this information and how it is used; (iii) how Arbopals protects the information from unauthorized access and disclosure and misuse; and (iv) how users of the Site can contact us to correct or delete this information.
The Arbopals Privacy and Security Policy is incorporated by reference into the Arbopals Terms of Use and applies to all users of the Site.
Personal and Other Information Collected by Arbopals
Arbopals collects information in a variety of ways on the Site, only as reasonably necessary for the management of the Site and for users to participate in the Site’s various activities.
- User Accounts and Arbopal Names. In order to create an Arbopal avatar and play in the Arbopals Virtual World or to purchase an Arbopals membership (“Membership”), visitors must first join and create a user account (“User Account”) under an Arbopal user name of their choosing (“Arbopal Name”).
- Account Set-up Info. Setting up a User Account requires visitors to: (i) create an Arbopal Name; (ii) create a password; (iii) provide their real name; (iv) provide a parent’s email address; and (v) select their country of origin (collectively, “Account Set-up Info”). Arbopal Names created by users are subject to review by Arbopals for uniqueness and compliance with the Arbopals Terms of Use. The Arbopal Name is the only information displayed along with the Arbopal avatar and publicly visible in the Arbopals Virtual World. Arbopals collects Account Set-up Info exclusively for the internal purpose of activating and monitoring User Accounts and Memberships. If a user fails to comply with the Site’s Terms of Use, Arbopals may use the user’s Account Set-up Info, including the Arbopal Name, and email address provided, to suspend or terminate the user’s account.Arbopals may also use the email address provided as part of the Account Set-up Info to give notice to users of any changes to the Site, including material changes to the Terms of Use, and this Privacy and Security Policy.
- User Content.Certain activities on the Site allow users to create and submit text, artwork, and other similar creative materials (collectively “User Content”). Under the Arbopals Terms of Use, users agree not to submit User Content which is unlawful or infringing on the proprietary and other legal rights of other persons. All User Content is screened by Arbopals before being displayed in the Arbopals Virtual World or elsewhere on the Site to ensure that it complies with the Arbopals Terms of Use and to ensure that no PII, such as the user’s real name, address, email address, etc., or any Account Set-up Info other than the Arbopal Name is shown anywhere on the Site.
- Billing and Credit Card Info. Purchasing a Membership, merchandise, or tree on the Arbopals’ Shop pages requires users to enter the following billing information (from a parent or guardian if the purchaser is a child): (i) Name; (ii) Address; (iii) City; (iv) Postal/Zip code; (v) Country; and (vi) Email address (collectively, “Billing Info”). Users must also enter the following credit card payment details (of the parent or guardian in the case of a child) in order to complete a purchase transaction: (i) Cardholder name; (ii) Credit card number; (iii) Expiration date; and (iv) Security Code on back of credit card (collectively, “Credit Card Info”). Billing Info and Credit Card Info are used exclusively for the purpose of processing and fulfilling purchase transactions of users, such as purchases of Memberships, merchandise or trees, and are protected via secure socket layer (SSL)-encryption. Arbopals does not store any Billing Info or Credit Card Info on its servers.Billing Info and Credit Card Info are securely routed to Arbopals’ payment gateway and processing service providers who are responsible for performing all payment processing services.Arbopals’ payment gateway and processing service providers are contractually bound to protect the privacy and security of all personal information they receive and to limit the use of this information to the payment services they provide.
- Site Management. Arbopals may passively collect certain computer information from visitors to, or users of, the Site such as: (i) the type of computer operating system used (e.g., Windows XP/Vista or Mac OS); (ii) the type of web browser used (e.g., Internet Explorer, Safari, Firefox); (iii) the user’s Internet Protocol (IP) Address; (iv) the frequency with which visitors/users access various parts of the Site. Arbopals may collect this non-personally identifiable information through the use of software technologies such as “cookies.” Cookies are small text files that are automatically placed in visitors’ computer browsers to store their preferences. Cookies allow users to store your password without having to re-enter it each time they play on the Site. They do not store personal information. You can have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies through your browser settings (refer to your browser Help menu to learn how to modify your computer’s cookies. If you turn cookies off, you may not have access to features that make Web browsing a smoother experience.
- Email Communications from Users. If users contact Arbopals by email () for help or any other reason Arbopals will use the user’s email address only to respond to the specific request or question, after which the address is deleted.
Information Arbopals Discloses to Third Parties
- Arbopals does not disclose any PII to third parties except as indicated in Section 4 of this policy and except in the following circumstances:
- if required to do so by law;
- if necessary, to service providers who provide IT or fraud and security-related support for the operations of the Site (“IT Service Providers”) and for that purpose alone; IT Service Providers are contractually bound to protect the confidentiality of PII;
- in the event of any significant transaction such as the sale, merger, amalgamation, financing, liquidation or insolvency of Arbopals or its business or assets, including the Site (“Re-organization Event”), Arbopals may be required to provide access to Arbopals’ customer lists and other PII as part of the due diligence process;in the event of a Re-organization Event, Arbopals would require that third parties sign a strict confidentiality agreement before being given access to PII.
Security
- Arbopals has put in place appropriate physical, electronic, and managerial procedures designed to help safeguard users’ PII from loss, unauthorized access, disclosure, alteration or destruction, including secure socket layer (SSL) encryption, firewalls, password protection, and other security measures including internal restrictions on who within Arbopals may access PII.
